What should I do if I have received a Notice of Intended Prosecution (NIP)?

If you have received a notice of intended prosecution, you should seek legal advice straight away.

A notice of intended prosecution (NIP) is the police letting you know that an offence has been recorded and they intend to prosecute the individual responsible for the offence. The NIP is usually issued within 14 days of the offence taking place.

If you have received a notice of intended prosecution, you will also receive a request for driver information. You, as the registered keeper, are legally required to provide the driver's details at the time the offence took place. Details must be completed and returned within 28 days of the request. If you fail to do so, you could be charged with failure to supply information.

What if I haven’t received a notice of intended prosecution within 14 days?

If you have committed a driving offence, you should receive a notice of intended prosecution within 14 days of the offence taking place. If you do not receive it within 14 days, any prosecution could be considered invalid. However, there are some exceptions:

  • If you have been given a verbal warning by the police at the time of the offence;

  • If the police could not reasonably find the information to send a notice of intended prosecution for example if you've moved to a new house without updating your registered address;

  • If you have been involved in an accident, you will not be sent a notice of intended prosecution as your knowledge of being involved in an accident is considered notification;

  • If you didn't own the car and the NIP was sent to the registered keeper of the vehicle, it could still be valid if the owner of the vehicle received it.
