Case Study 1:

Patient left unattended with a cigarette indoors in a care home for dementia patients. The patient was set alight and suffered 30% burns. After a number of months, the patient died prematurely as a result of the incident. Family received £25,000 in compensation.

Case Study 2:

The Claimant was admitted to a Residential and Dementia Care Centre, with a medical history of Dementia, Hypertension, Cataracts, Type 2 Diabetes, Chronic Kidney disease and small vessel cerebrovascular.

A Care Plan was completed by the Care Home which confirmed that the Claimant was at very high risk of falls, following a most recent fall downstairs at their previous accommodation, for which they had been admitted to hospital. Additional notes were placed on the care plan to alert staff that due to their mental capacity and very high risk of falls they required 1:1 assistance and supervision.

The Claimant then suffered 7 unwitnessed falls at the care home, the last of which in an area where the Claimant was not permitted access, resulting in a fall down a flight of stairs and causing a fracted skull.  It was suggested in the Serious Investigation review that the Claimant had been on the floor for several hours before being found by care home staff.  The Claimant was taken to Hospital where their condition deteriorated, and they sadly passed away 4 weeks later.

The Claim was brought on behalf of the Estate of the Claimant for failing to provide adequate supervision, failure to complete adequate risk assessments and for failing to ensure that suitable door locks / barriers were in place to avoid foreseeable injury to residents with advanced dementia. But for the negligence the Claimant would not have been injured.

The Defendants admitted negligence at the pre-litigation stage and offered the Claimant’s Estate £30,000 which was accepted.
