This is a method of conflict resolution used for commercial disputes that involves all parties voluntarily and willingly entering the process to come to a decision that everyone is happy with. It is used to avoid court proceedings, so that disputes can be resolved quickly and provide certainty to any business or organisation involved.

There are a few different reasons that mediation may be the best course of action when it comes to resolving a dispute. It may be a disagreement between an employer and an employee union, concern a breach of contract, be because of fraud or other illegal activities, or just generally be to do with negligence.

Whilst the mediation period is much shorter than court proceedings, as well as being less expensive, the time it takes can vary depending on how quickly an agreement is reached. This means that in some cases it can take a matter of weeks, and in others it can take months.

The process of mediation is fairly simple, with a preliminary session where goals and objectives are established, and then following several meetings where negotiations are had. If the dispute is simple it could take one session, but in other cases it can take more.
