The Claimant was injured in a pedestrian road traffic accident when a car collided with them as they walked. As a result of the collision, the Claimant suffered multiple injuries, with the most serious being a leg injury. The Claimant faced the possibility of amputation due to the non-union of the bone. After extensive treatment and therapy, the bone healed, but the Claimant was left with ongoing pain, stiffness, tinnitus, PTSD and scarring. The injuries meant the Claimant could no longer pursue their chosen career and would face long-term physical restrictions.
Following the accident, the Claimant contacted Forbes Solicitors to claim the injuries they sustained. When Forbes Solicitors contacted the Defendant, they admitted liability for the accident. However, the valuation of the claim was delayed due to uncertainty about the Claimant's recovery and they disputed the extent of the Claimant's future care and support. The proceeding was issued to resolve these issues. A few months before the trial was listed, the parties agreed settlement terms at a joint settlement meeting.
The case was settled by John Bennett, one of Forbes Solicitors Personal Injury expert solicitors for £675,000. Throughout the process, John meticulously managed the complexities of the case, including addressing the uncertainties surrounding the Claimant’s recovery, future losses and care requirements. His expertise in managing difficult negotiations with the Defendant, especially in the face of disputes regarding the extent of the Claimant’s future needs, was instrumental in reaching a favourable outcome without the need for a trial.
